These terms govern your use of datasetbyhumans.com (the "site") and orders placed with Dataset By Humans ("we", "us"). Your rights to use images and other data are set out in the license terms, which form part of every order.

1. Who may use the site

The site is intended for individuals aged 18 or over and for businesses and other organisations. By using it you confirm that you meet this requirement and that, if you act for an organisation, you are authorised to bind it.

2. Requests, samples and quotes

Submitting a request or asking for samples does not create an obligation for either party. Quotes describe the dataset, price, delivery timeline and license, and are valid for 30 days unless they say otherwise.

Free samples are provided for evaluation only and may not be used to train production models unless a license says otherwise.

3. How ordering works

Online payment is not available at the moment. Orders are placed on the site from a customer account, or by email:

1. You choose the item, package and license on the site and place the order from your account (or email us the same details), with the person or organisation the license is issued to and your billing country. No payment is taken when you place the order.
2. Our team contacts you to confirm the details and sends an invoice within 48 hours. A contract is formed when we confirm your order in writing.
3. Single images: we deliver the full-resolution original, its metadata record and a license certificate by email within 48 hours of receiving payment.
4. Dataset packages and custom collections: the invoice is for a deposit (shown on the pricing table). We confirm the specification, send samples before full production, deliver in parts, and invoice the balance with the final delivery.

We may decline an order, for example if an image is no longer available or the intended use is not allowed under our license terms. If we decline after you have paid, we refund you in full.

4. Customer accounts

You are responsible for keeping your password confidential and for orders placed from your account. Tell us at once if you think someone else has used it. We may suspend accounts used to abuse the site. You can ask us to delete your account at any time; orders and invoices are kept as described in the privacy policy.

5. Prices, invoices and taxes

Prices are shown in US dollars and exclude sales tax, VAT or similar taxes, which are added to the invoice where they apply. Invoices are payable within 14 days by the payment methods stated on the invoice. Bank and transfer fees on your side are paid by you. If a business customer is responsible for tax under a reverse-charge rule, please give us your tax ID so we can show it on the invoice.

The price confirmed in our order confirmation applies, even if the price on the site changes later.

6. Delivery and acceptance

Files are delivered electronically, by email or a time-limited download link. Please check each delivery and tell us within 7 days if it is incomplete, corrupted or does not match the description or agreed specification; we will fix or replace it. Refunds are covered by the refund policy.

7. Datasets and licenses

Images and datasets are licensed, not sold. Your rights are defined by the license on your order; see licensing. Unless your license says otherwise, you may not redistribute or resell the raw data. The license starts when the invoice for the item (or, for bundles, the final balance) is paid in full.

8. Acceptable use

You agree not to misuse the site, including by attempting to gain unauthorised access, submitting spam or automated requests, or scraping content in bulk. You must not use our images or datasets to identify, track or profile the people who appear in them.

9. Sanctions

We do not do business with persons or entities subject to sanctions imposed by the United Nations, the European Union, the United Kingdom or the United States, or located in comprehensively sanctioned territories.

10. Intellectual property

The site's content, design, sample images and example records are owned by us or our licensors. You may share links to the site freely.

11. Disclaimers and liability

The site is provided "as is". Our datasets are delivered as described, but we do not guarantee that they will achieve any particular model performance. Expert Q&A datasets (for example legal, tax or health) contain general information as of the date stated in each record and are not professional advice. To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability for an order is limited to the amount you paid for it. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

12. Changes

We may update these terms. The version that applies to an order is the one published on the date we confirm it.

13. Governing law

These terms are governed by the laws of Singapore, without prejudice to mandatory consumer protection laws of your country of residence.
